- Permitted Use: The Service is intended solely for editing and managing website content. Any other use of the Service is strictly prohibited.
- User Responsibilities: You are solely responsible for the content you create using the Service. Canaveral CMS takes no responsibility for user-generated content.
3. Subscription, Payment, and Cancellation
- Billing and Payment: Upon upgrading to a paid plan, you will be billed in advance on a monthly or yearly basis. All payment obligations are non-cancelable and all amounts paid are non-refundable, except as specifically provided in these Terms.
- Refund Policy: Refunds are provided within 14 days of initial payment upon request.
- Renewals and Cancellations: Your subscription will automatically renew unless you cancel it. You may downgrade to a free plan or cancel your subscription at any time.
4. Intellectual Property Rights
- User-Generated Content: You retain all rights to the content you create while using the Service. However, by creating content, you grant Canaveral CMS a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content to the extent necessary to provide the Service.
- Restrictions on Use of Canaveral CMS Material: You may not use any content, trademarks, logos, or any other proprietary information of Canaveral CMS without express written consent.
5. Liability and Warranty Disclaimer
- Service “As Is”: The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
- Limitation of Liability: In no event will Canaveral CMS, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Service, any websites linked to it, any content on the Service or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

- Jurisdiction and Governing Law: These Terms shall be governed by and construed in accordance with the laws of the state of Wyoming, USA, without regard to its conflict of law provisions.
- Arbitration: In the event of any dispute arising from or related to these Terms, the parties agree to submit to binding arbitration in the state of Wyoming, USA, in accordance with the rules of the American Arbitration Association.
8. Amendments to Terms
- Right to Amend: Canaveral CMS reserves the right, at its sole discretion, to modify or replace these Terms at any time. It is your responsibility to check these Terms periodically for changes.
- User’s Acceptance of Changes: Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
9. Termination
- Breach of Terms: Canaveral CMS may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms.
- Effect of Termination: Upon termination, your right to use the Service will cease immediately. The provisions of these Terms, which by their nature should survive termination, will survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Canaveral CMS regarding the Service and supersede all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy, or precedent.
- No Waiver: The failure of Canaveral CMS to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
